The New Electoral Code: What&#8217;s What?"},"content":{"rendered":"<p><\/p>\n\n\n\n<p>The local elections are getting closer, so it is time to clear up all things concerning the new Electoral Code, as there are really a lot of questions. First of all, it should be discussed with the activists and citizens who care about the future of their city, village or community. During the webinar \u201cThe new Electoral Code. Local elections\u201d together with the expert of the Institute of Political Education Oleksandr Solontay we discussed the main changes in the legislation.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"576\" src=\"https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-1024x576.jpg\" alt=\"\" class=\"wp-image-15440\" srcset=\"https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-1024x576.jpg 1024w, https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-300x169.jpg 300w, https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-768x432.jpg 768w, https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-1536x864.jpg 1536w, https:\/\/inrespublica.org.ua\/wp-content\/uploads\/2020\/08\/Aktyvna-Gromada_Solontay-_Vyborchyy-_kodeks-2048x1152.jpg 2048w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>The new version of the Electoral Code covered a large number of different processes.<\/p>\n\n\n\n<p><strong>What is the new Law of Ukraine of July 16, 2020 about?<\/strong><\/p>\n\n\n\n<p>About the amendments to some legislative acts of Ukraine concerning improving the election legislation:<\/p>\n\n\n\n<ul><li>The Code of Administrative Offenses;<\/li><li>The Electoral Code;<\/li><li>The Criminal Code;<\/li><li>About the status of deputies of local councils;<\/li><li>About the Central Election Commission;<\/li><li>About the amendments to some laws of Ukraine regarding defining the territories and the administrative centers of the territorial communities;<\/li><li>About the parliamentary elections;<\/li><li>About the local government in Ukraine.<\/li><\/ul>\n\n\n\n<p><strong>What exactly has changed?<\/strong><\/p>\n\n\n\n<p>Since July 16, 2020, several changes have been made. A lot of different national and local processes are covered.<\/p>\n\n\n\n<p><strong>The new system:<\/strong><\/p>\n\n\n\n<ul><li><strong>Changes everywhere, even in the village.<\/strong> For the first time in the history of Ukraine, there have been introduced such a modification: the elections to the village councils are based now on party lists. This is a serious innovation of the Electoral Code. On January 1, 2020, when the New Electoral Code came into force, it affected the electoral system in villages and settlements for the first time. Previously, the legislation changed for each local election in Ukraine, but the electoral system for village and settlement councils had never changed. The Electoral Code of 1 January did it for the first time. In particular, instead of single-member district with one deputy seat, the constituencies with two or even three and four deputy seats appeared. That is at least 2 seats per district. The changes of July 16, 2020 divided all village and settlement councils into communities with 10,000 voters or without 10,000 voters. Taking into account that before this, on June 12, the Cabinet of Ministers completed the process of communities\u2019 unification, and after changes in the legislation of July 16 the elections in the new communities will be held on this new administrative-territorial basis on October 25, the elections under the new legislation will be held for the first time in the villages.<\/li><li><strong>Partisation starting from 10 thousand<\/strong>. For the first time in 15 years, the elections will be held on the majoritarian basis in the cities of regional significance and in some selected city councils of cities of district significance. Previously, the elections in all city councils were held on the proportional party-list basis.<\/li><li><strong>Gender quotas, 2 \\ 5 or 30%.<\/strong> Gender quotas have been introduced from January 1, 2020, but from July 16, 2020, this law has been strengthened: every second person should be of a different gender, so there will be at least 30% of men or women in each local council.<\/li><li><strong>Local political programs.<\/strong> Previously, the electoral programs had to be submitted in only 30 large communities. Now the candidates of all communities with more than 10,000 voters must submit the election programs.<\/li><li><strong>The electoral<\/strong><strong> <\/strong><a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/deposit+has+been+introduced\"><strong>deposit<\/strong><\/a><strong>s at all levels for all candidates.<\/strong> The electoral <a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/deposit+has+been+introduced\">deposit<\/a>s have been reduced, compared to those introduced on January 1, 2020. However, now the electoral <a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/deposit+has+been+introduced\">deposit<\/a>s are everywhere.<\/li><li><strong>The representation of the deputy groups at the level of electoral commissions, except for parliamentary ones.<\/strong> This is a unique innovation in the history of Ukrainian electoral legislation.<\/li><li><strong>Technical errors. <\/strong>Some technical errors were corrected, others were left, and others occurred. These technical errors <a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/impede\">impede<\/a> the exercise of the <a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/election+process\">election process<\/a>. This opens the way for the Verkhovna Rada to amend the Electoral Code in September 2020.<\/li><li><strong>The incomprehensible duality of running.<\/strong> From January 1, the abolition of double and triple voting was introduced. The double and triple voting was earlier normal in the local elections, when the candidate could run anywhere at the same time. Instead of this, double running in different councils was introduced.<\/li><\/ul>\n\n\n\n<p><strong>How is the number of district deputies determined?<\/strong><\/p>\n\n\n\n<p>According to the new Electoral Code, the composition of local councils has been renewed.<\/p>\n\n\n\n<p>Each council has some deputies, regardless of the number of voters in the village. If there are less than 10,000 voters, then there should be 22 deputies. In order to understand the number of constituencies, we need to divide 22 deputies by 3 and we get 7 constituencies. In 7 constituencies people should elect 22 deputies. In one constituency there will be 2 deputies, in another &#8211; 4 or 3. Your village will belong to some constituency. Most likely, it will be together with such small districts as yours. Then, accordingly, each district, each microdistrict, each village will have its own deputy. In case you elect a lazy deputy who does not want to work, than there will be another <a href=\"https:\/\/context.reverso.net\/%D0%BF%D0%B5%D1%80%D0%B5%D0%B2%D0%BE%D0%B4\/%D0%B0%D0%BD%D0%B3%D0%BB%D0%B8%D0%B9%D1%81%D0%BA%D0%B8%D0%B9-%D1%80%D1%83%D1%81%D1%81%D0%BA%D0%B8%D0%B9\/hardworking\">hardworking<\/a>, deputy. And in terms of community management it does not matter will he live in your village or not much.<\/p>\n\n\n\n<p><strong>How is the number of constituencies calculated according to the new Electoral Code?<\/strong><\/p>\n\n\n\n<p>Divide the number of deputies by 10 and get the average number of constituencies.
